ALL ATTENDEES OF BRAZE RANCH LLC ("BRAZE") CROP MAZE/ FALL FESTIVAL (the “EVENT”), MUST AGREE TO THIS AGREEMENT IN ORDER TO ENTER THE EVENT. ENTRY INTO THE BOUNDARIES OF THE EVENT SHALL BE CONSIDERED ACCEPTANCE ON BEHALF OF THE ATTENDEE AND ANY ACCOMPANYING MINOR ATTENDEE. INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER AGREES TO (1) ASSUME ALL RISKS OF COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL BRAZE HEALTH & SAFETY POLICIES.Attendee expressly waives and releases any and all claims which they have or may in the future have against Braze, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors and assigns and the owners or lessees of any premises used for Event (collectively, “Releasees”), on account of injury, death or property damage arising out of or attributable to Attendee’s participation in the Activities, due to any cause whatsoever, including without limitation the negligence of the Braze or any other Releasee, breach of contract, or breach of any statutory or other duty of care owing under occupiers liability legislation or otherwise. Attendee covenants not to make or bring any such claim against the Braze or any other Releasee, and forever releases and discharges Braze and all other Releasees from liability under such claims.The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida and the federal laws of the United States applicable therein. Any claim or cause of action arising under this Agreement may be brought only in the courts in Alachua County Florida, and Attendee hereby consent to the exclusive jurisdiction of such courts.Photographs and/or audio/video recordings taken at the Event may include Attendee's image, name, voice and/or likeness. By attending and/or participating in the Event, Attendee hereby grants Braze permission to perpetually use, and to sublicense to third-parties, Attendee's photograph, image, likeness, voice and statements (whether in writing or orally) for any purpose, including, without limitation, commercial purposes, without compensation or credit to Attendee, in any and all media, worldwide, now known or hereafter devised.ATTENDEE ACKNOWLEDGES THEY HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND ARE VOLUNTARILY WAIVING SUBSTANTIAL LEGAL RIGHTS (ON THEIR BEHALF AND ON BEHALF OF THEIR HEIRS, EXECUTORS, ADMINISTRATORS AND NEXT-OF-KIN), INCLUDING THE RIGHT TO SUE THE BRAZE AND THE RELEASEES.
